These terms apply to the TONearby mobile app and the tonearby.com website (together, “TONearby”). By using TONearby you agree to these terms.
1. What TONearby Is
TONearby is an independent information service that helps you discover parks, community centres, and drop-in recreation activities using public data, including City of Toronto open data. TONearby is not affiliated with, endorsed by, or operated by the City of Toronto.
2. Information Accuracy
Schedules, amenities, alerts, and other recreation information come from public data sources that may change, lag, or contain errors. Sessions can be cancelled, times can move, and facilities can close without notice. Always confirm details with the facility or the City of Toronto before making plans. TONearby does not guarantee the accuracy, completeness, or timeliness of any information it displays.
3. Accounts
An account is optional. If you create one, keep your sign-in details secure — you are responsible for activity under your account. Provide accurate information and do not impersonate anyone. We may suspend or remove accounts used to abuse the service. You can delete your account at any time — see Delete your account.
4. Acceptable Use
Do not:
- interfere with or disrupt the service, or attempt to access data that is not yours
- use automated tools to scrape or bulk-extract content from the app or website in ways that burden the service
- use TONearby for anything unlawful
5. Intellectual Property
The TONearby name, logo, app, and website design belong to TONearby. Public recreation data belongs to its respective publishers, including the City of Toronto, and is used under their open data licences.
6. Disclaimer and Limitation of Liability
TONearby is provided “as is” and “as available,” without warranties of any kind, to the maximum extent permitted by law. TONearby is not liable for indirect, incidental, or consequential damages, or for losses arising from reliance on information shown in the app or on the website — including cancelled sessions, incorrect schedules, or facility conditions.
7. Changes
We may update TONearby and these terms over time. Material changes will be reflected on this page with an updated date. Continuing to use TONearby after changes means you accept the updated terms.
8. Governing Law
These terms are governed by the laws of the Province of Ontario and the laws of Canada applicable in Ontario.
